Des juges politisés, une justice intervenant de plus en plus directement dans le champ de l'action politique : la question des rapports entre justice et politique conduit à s'interroger sur les missions du juge, sa légitimité et sa place dans l'organisation des pouvoirs. Les manifestations de l'ingérence des juges dans la politique sont nombreuses et multiformes. Au-delà des polémiques, en réalité de nature politique, et de l'invocation rituelle du principe d'indépendance, elles traduisent une confusion des genres tendant à brouiller l'image et le fonctionnement de la démocratie.
La reforma de la Constitución
Reformar o adoptar una Constitución es un acto mayor. Esta rige no solo el funcionamiento de las instituciones, sino también los valores que comparten los ciudadanos. Una Constitución es un conjunto de principios, de valores, de instituciones y de mecanismos cuyo objetivo es el ejercicio del poder. Es a la vez el marco y el espejo de la sociedad. Es el puente entre la historia de una Nación y su futuro. En una democracia, la Constitución manifiesta la expresión de una voluntad común, la identidad de un Pueblo, así como las relaciones que este busca construir tanto con los otros Estados como con la sociedad internacional. Es también un acto de soberanía. De manera directa o indirecta, la adopción de la norma suprema manifiesta la voluntad del soberano.

The executive power really is a governmental power. Whether it is in the hands of a President or a Prime Minister, depending on the political regime, it relates to the fundamental interests of the Nation or the State's policy. The system according to which the Parliament votes the law and the executive enforces it, is a fiction. In France, as in most parliamentary democracies, the Government or the Head of the State decides the policy of the State. It receives the legitimacy to do so from popular elections. Majority rule, let alone institutional differences, implies that the People choose who occupies the seat of executive power. The issue before us is to know who controls the executive functions of government in Western democracies. In the French system, the answer can seem ambiguous. The presidential and legislative elections of 2017 reflect the permanence of these structuring elements of the Fifth Republic. = Исполнительная власть является государственной независимо от того, в чьих руках она находится – президента или премьер-министра, – и независимо от того, касается она фундаментальных интересов нации или государственной политики. Система, при которой парламент принимает закон, а исполнительная власть его исполняет, – фикция. Во Франции, как и в большинстве демократических государств, государственную политику осуществляют правительство или глава государства, которые обретают легитимность в результате выборов. Исследуется вопрос о том, кто контролирует исполнительные функции правительства в западных демократиях. Обосновывается мысль о том, что во французской системе ответ может показаться неоднозначным: президентские и законодательные выборы 2017 г. отражают постоянство этих структурных элементов Пятой Республики.

La nouvelle Constitution marocaine reconnaît l'existence d'un véritable pouvoir judiciaire et met en place un organe, le Conseil supérieur du pouvoir judiciaire, garant de son indépendance et doté de larges compétences s'agissant de la gestion des magistrats et de la politique judiciaire. Cette réforme, qui s'accompagne d'une transformation du contentieux constitutionnel, alloue au Maroc un outil constitutionnel novateur et performant. Cependant cette réforme est tributaire des lois organiques nécessaires à son accomplissement.

The new Moroccan Constitution acknowledges the existence of a real judicial power and establishes a new body to guarantee its independence, the Superior Council of the Judiciary, vested with wide powers regarding the monitoring of magistrates and judiciary policy. This reform, together with a transformation of the framework of constitutional litigation, provides Morocco with an innovative and effective constitutional instrument.
